Terms of service

This website is operated by Tactical Medical Solutions, LLC (TacMed). TacMed offers this website, including all information, tools, services and items for purchase available on the website to the user, conditioned upon the user's acceptance of all applicable terms, conditions, policies, and notices. By accessing, using, or making a purchase via any part of this website, the user agrees to be bound by the terms and conditions set forth herein. TacMed reserves the right to update, change, or replace any part of these terms and conditions by posting updates and/or changes to its website. Continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. 
 

RETURNS, EXCHANGES, & PAYMENT POLICIES 

 Any discrepancies with shipments (such as shortages, overages, or incorrect items) must be reported to TacMed™ no later than 10 days from date of shipment. TacMed™ will not be held responsible for discrepancies after this period. 

Returned items must be unused and unopened and will be assessed a 20% restocking fee. We will not accept sterile items for return or exchange. Discontinued and sale items are final sale and cannot be returned. 

Payments in excess of 30 days are subject to interest charges of 0.05% per day (1.5% per month). 

In the event an account is placed in collection or other legal action, the customer shall be responsible for all TacMed™ costs and expenses including but not limited to TacMed's reasonable attorney fees. 

 
 BODY ARMOR PURCHASE TERMS 

By purchasing body armor sold on this website, the purchaser confirms that s/he is a legal adult of at least 18 years of age, has not been convicted of a felony, and is a U.S. citizen, U.S. permanent resident, or has been granted asylum or refugee status in the U.S. The purchaser further confirms that s/he does not have a criminal background and is legally permitted to purchase the body armor under applicable state and federal law. TacMed reserves the right to refuse any body armor sale suspected of being placed by or delivered to a minor, convicted felon, suspected criminal, or foreign person, as well as any person who TacMed perceives as a potential threat to law enforcement or the community. 

TacMed does not offer for sale or delivery into the state of Connecticut any body armor items due to restrictions under state law. Any attempted purchase with a ship-to address located in Connecticut will not be allowed to proceed. 
 

EXPORT CONTROLS 

Certain protective products sold on TacMed's website, including but not limited to Level III helmets and body armor, are subject to U.S. export controls, pursuant to either the Export Administration Regulations, 15 C.F.R. §§ 730-774 (EAR), or the International Traffic in Arms Regulations, 22 C.F.R. §§ 120-130 (ITAR). Exports or transfers of controlled products out of the United States or to foreign persons (as defined in the EAR and ITAR) without prior authorization from the U.S. government are prohibited. As a result, any attempted purchase of controlled products by a foreign person or with a ship-to address located outside of the United States will not be allowed to proceed. 

TacMed is committed to conducting business in full compliance with applicable U.S. export control laws and regulations, including but not limited to the EAR and ITAR, and takes such compliance obligations seriously. Accordingly, TacMed's customer service team may request proof of the U.S. nationality and/or residency of the purchaser and/or ship-to party before completing a transaction and shipping any protective products, in order to confirm that the shipment is not being made to a foreign person. By placing an order on this website, the purchaser agrees to these requirements and that such a request must first be satisfied before shipment will be made. If the purchase refuses to provide the requestd information, TacMed will cancel the order and issue a refund.

Arbitration and Class Action Waiver Agreement:

Arbitration:

By using or purchasing TacMed Solutions™ products or services, you agree that any controversy, claim, action, or dispute between you and TacMed Solutions™ arising out of or relating to: (a) these Terms, or the breach thereof; or (b) your access to or use of TacMed Solutions™’s website or the services or the materials; or (c) any alleged violation of any federal or state or local law, statute or ordinance (each such controversy or claim, a “Claim”), shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association in accordance with its applicable rules.

Arbitration is a form of dispute resolution in which parties agree to submit their disputes and potential disputes to a neutral third person (called an arbitrator) for a binding decision, instead of having such dispute(s) decided in a lawsuit, in court, by a judge or jury trial. The arbitrator is obligated to issue a reasoned award in writing, including all findings of fact and law upon which the award was made. The arbitrator shall not have the power to commit errors of law, and the arbitrator’s award may be vacated or corrected through judicial review by a court of competent jurisdiction. Each party’s attorneys’ fees, expert costs, and other costs and expenses incurred in connection with arbitration will be borne by the party incurring such costs and expenses.  

Arbitration Procedures:

Claims shall be heard by a single arbitrator. Arbitrations shall be held in Anderson County, South Carolina, USA, but the parties may choose whether to appear in person, by phone, or through the submission of documents.  The arbitration shall be governed by the Federal Arbitration Act (“FAA”) and by the internal laws of the South Carolina, without regard to conflicts of laws principles. Any disputes in this regard shall be resolved exclusively by an arbitrator. If, but only if, the arbitrator determines the FAA does not apply, New York law governing arbitration agreements will apply. All disputes with respect to whether the foregoing mutual arbitration provisions are unenforceable, unconscionable, applicable, valid, void or voidable shall be determined exclusively by an arbitrator, and not by any court.

Exclusion from Arbitration:

Notwithstanding the terms of this Arbitration Agreement, you may choose to pursue a Claim in court and not by arbitration if you opt-out of these arbitration procedures within 30 days from the date that you first purchase any of TacMed Solutions™’s products or services (the “Opt-Out Deadline”). You may opt out by mailing a written notification to 1250 Harris Bridge Road, Anderson, South Carolina 29621. Your written notification must include (1) your name, (2) your address, and (3) a clear statement that you do not wish to resolve disputes through arbitration. Your decision to opt-out will have no adverse effect on your relationship with [Brand]. You are responsible for ensuring TacMed Solutions™’s receipt of your opt-out notice, and you therefore may wish to send a notice by means that provide a written receipt.  Any opt-out request received after the Opt-Out Deadline will not be valid and you must pursue your Claim in arbitration.

Class Action Waiver:

You and TacMed Solutions™ agree that you may bring or participate in Claims against TacMed Solutions™ only in your respective individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.  Unless both you and TacMed Solutions™ agree otherwise in writing, the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated and may not otherwise preside over any form of a representative or class proceeding. Notwithstanding any other clause contained in this Agreement, any Claim that all or part of this Class Action Waiver is unenforceable, unconscionable, void or voidable may be determined only by a court of competent jurisdiction and not by an arbitrator.
